TERMS OF USE

This website (the “Site”) is owned and operated by Georgetown University in Qatar (hereinafter referred to as the “GU-Q”, “we”, “our” or “us”). For the purposes of these terms of use (these “Terms”), the “Site” means an application, portal or any other platform which we own and operate.

ACCEPTANCE OF THESE TERMS

By accessing the Site, you agree to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local law. If you do not agree to these Terms, you should not access the Site or any pages thereof.  

These Terms constitute the entire and only agreement between us and you, and supersede all prior or contemporaneous agreements, representations, warranties and understandings with respect to your use of the Site. Otherwise, these Terms do not alter in any way the terms and conditions of any other agreement you may have with the GU-Q. These Terms may be amended at any time by us from time to time without specific notice to you. Any amendments or modifications to these Terms will be posted on the Site with a new revision date and will become effective immediately upon posting.

These Terms are in addition to other applicable policies, notices, guidelines and rules that may have been communicated by us to you. We may also publish additional policies, notices, guidelines and/or rules on the Site. 

DISCLAIMER

In no circumstances shall we be liable for any damage or loss of any kind caused as a result (direct or indirect) of your use of the Site, including but not limited to any damage or loss suffered as a result of your reliance on the contents contained in or available from the Site.

  1. ACCOUNTS

The Site may require you to create an account to participate in certain activities or functions. You must use only your own account(s) for accessing the Site, and may not attempt to impersonate the identities of others. You may not supply false or misleading data nor improperly obtain another’s password in order to gain access to the Site. The negligence or naivete; of another person in revealing an account name or password is not considered authorization of use. You should not use the convenience of file or printer sharing as justification for sharing an account. You must not attempt to subvert the restrictions associated with your accounts or network access.

  1. SECURITY INFORMATION

You are responsible and accountable for all use and security of electronic resources you own or use to access the Site, including but not limited to account(s), passwords, personal computer(s), electronic data, and network access. You should make appropriate use of the software, system and network-provided protection features and take precautions against others obtaining access to your electronic resources. You are responsible for the security of all NetIDs, accounts and passwords assigned for your use. Passwords must never be shared. You are expected to abide by the Georgetown University Information Security Policy.

  1. SHARED RESOURCES

You may not encroach on another’s use of the Site. Such activities would include, but are not limited to, illegally downloading or sharing music, movies, software or other files on the Site, or other non-GU-Q related applications; sending harassing messages; sending frivolous or excessive messages, including chain letters, junk mail, spam, and other types of broadcast messages over the Site; using excessive amounts of storage; launching attacks or probes, or otherwise attempting to subvert the security of the Site; intentionally or irresponsibly introducing any computer viruses, worms, Trojan Horses, spy ware, or other rogue programs to the Site.

  1. FUNCTIONALITY AND AVAILABILITY

You must ensure that your actions on the Site do not negatively impact the functionality and availability of the Site. You must ensure that your electronic resource is properly maintained, including having up-to-date anti-virus protection and operating system patches. Responsible use of the Site requires users to realize that any attempt to modify or extend the Site could result in degradation of systems or performance elsewhere on the Site. You must not disrupt routine operations by tampering with the Site without authorization or permission; circumventing or altering software or physical protections or other restrictions placed on the Site. Similarly, you may not make resources available to circumvent or alter software protections or other restrictions placed on the Site.

  1. INTELLECTUAL PROPERTY

You acknowledge that all materials on the Site are protected by copyright, trade mark, and/or other intellectual property rights. These materials are owned by us or are used with permission from their owners or as otherwise authorized by law. Protected materials include, but are not limited to, text, trademarks, source code, databases, logos, photographs, images, video clips, audio clips, designs, trade dress, and other materials contained on the Site. All rights are reserved, worldwide. 

You are permitted to use this material only as expressly authorized by us. We reserve all rights not expressly granted in and to the Site and the content on the Site. You agree not to copy, publish, republish, redistribute, archive, store, adapt, alter, modify, translate, create derivative works from, summarize, photocopy, scan, syndicate, sell, license, frame, harvest, scrape, grant or purport to grant any rights in or otherwise make available any content from the Site.

You are responsible for using the Site in accordance with copyright and licensing restrictions and applicable GU-Q policies. You may not use the Site to violate copyright or the terms of any license agreement. No one may inspect, modify, distribute, or copy proprietary data, directories, programs, files, disks or software from the Site without proper authorization.

  1. LIMITED RIGHT TO USE

The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, nonexclusive license for use solely by you for your own personal and non-commercial use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).

Unauthorized use of the Site or any of the information or material contained on the Site is illegal and as such may give rise to, amongst other things, a claim for damages and may also be a criminal offence.

  1. INDEMNIFICATION

You agree that you shall indemnify and hold us, our subsidiaries, affiliates, directors, officers, employees, members, agents, partners and licensees harmless from any and all claims, liabilities, cost or expenses, arising from any and all liabilities, losses, damages, claims, penalties, fines, costs and expenses, including without limitation, reasonable legal fees, that may arise in connection with (i) your use of the Site; (ii) your breach of these Terms; (iii) our publication, distribution or use of any materials provided by you; and (iv) any claim by a third party that any content provided by you to the Site or any other use of the Site by you infringes any intellectual property, other proprietary or privacy right of such third party or has otherwise caused damage to a third party.

  1. PUBLICATION

You should remember that information you distribute through the Site or other computing and networking facilities is a form of publishing and many of the same standards apply. For example, any web publication attributed to the GU-Q, even with disclaimers, represents you and the GU-Q and appropriate language, behavior and style is warranted.

  1. PRIVACY POLICY 

Any information collected on the Site is governed by our Privacy Policy available at qatar.georgetown.edu/privacy-policy. Our Privacy Policy, as it may change from time to time, is a part of these Terms. We reserve the right, and you authorize us, to the use and assignment of all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. 

  1. LINKS TO THIRD-PARTY WEBSITES

The Site may contain links to third-party websites. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked website on the Site does not imply approval or endorsement of the linked website by us. If you decide to leave the Site and access these third-party websites, you do so at your own risk.

  1. ACCURACY OF INFORMATION

We are not responsible if information made available on the Site is not accurate, complete or current. The material on the Site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on the Site is at your own risk. The Site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. 

We reserve the right in our sole discretion to modify, edit or delete any documents, information or other content appearing on the Site at any time, but we have no obligation to update any information on the Site. You agree that it is your responsibility to monitor changes to the Site.

  1. GOVERNING LAW AND JURISDICTION

These Terms shall be treated as though they were executed and performed in Doha and shall be governed by and construed in accordance with the laws of the State of Qatar (without regard to conflict of law principles). All legal proceedings arising out of or in connection with these Terms shall be brought solely in Doha, Qatar. You expressly submit to the exclusive jurisdiction of said courts and consent to extra-territorial service of process. Notwithstanding this, we reserve the right to bring enforcement proceedings in any court or courts including, if appropriate, in the courts of your country of residence.

  1. SEVERABILITY

Should any part of these Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site is in conflict or inconsistent with these Terms, these Terms shall take precedence. Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision.
